1. Introduction
Welcome to PentaBind. These Terms of Use ("Terms") exclusively govern your use of PentaBind's SELEX Convergence Tool (the "Service") offered as part of a limited-time promotional access for academic and industry researchers conducting Systematic Evolution of Ligands by Exponential Enrichment (SELEX) in their laboratories. This promotion is distinct and separate from any other services PentaBind may offer concurrently or in the future. By accessing or using the Service under this promotion, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.
2. Eligibility
The Service is available to academic and industry researchers who:
- Are conducting SELEX in their own laboratories or an organisation who has access to SELEX data.
- Have applied and been confirmed eligible for the promotion by PentaBind.
Eligibility is determined at PentaBind's sole discretion.
3. Promotion Period
This promotional offer grants unlimited uses of the SELEX Convergence Tool for two (2) months from the date you first share data with PentaBind. PentaBind reserves the right to modify, cancel, or extend the promotion at its discretion.
4. Use of the Service
During the promotion period, you are granted unlimited uses of the Service to:
- Analyse current and past SELEX experiments.
- Gain insights into your SELEX processes.
- Refine your SELEX strategy.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
5. Intellectual Property and Data Use Rights
Ownership
- Users retain full ownership of all data submitted to the Service as well as the intellectual property rights in the analysis and reports generated by the Service.

Publication Rights for Industry Reports
- By utilising the Service, users grant PentaBind the right to publish industry analysis reports that may include aggregated and anonymised metadata and enrichment analysis derived from user data. These reports are intended for public use to contribute to the broader understanding and development of the SELEX field.
- PentaBind is expressly prohibited from using this metadata and enrichment analysis for research and development purposes, for improving its AI algorithms, or for any purpose other than the creation of industry analysis reports.
Exclusions from Reports
- PentaBind guarantees that these industry analysis reports will not include any personally identifiable information, organisation identifiable information, specific SELEX data, or aptamer sequence data. The intent is to ensure the confidentiality and integrity of proprietary information while enabling PentaBind to share valuable industry insights.
Purpose of Publication
- The publication of industry reports by PentaBind serves the dual purpose of contributing to the scientific community and industry knowledge base, and demonstrating PentaBind's capabilities and insights in the field. This activity is restricted to the creation and dissemination of generalised industry insights that do not compromise user confidentiality or intellectual property.

6. Service Availability and Technical Issues
- The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted access and may temporarily disable access to the Service for maintenance or due to technical issues.
- We will make reasonable efforts to notify users of any planned downtime in advance.
- PentaBind will process your data as quickly as possible but does not provide guarantees on the turnaround time for delivering AI insights and reports.
7. Data Security and Breach Notification

- We commit to maintaining industry-standard security measures to protect your data.
- In the event of a data breach, we will notify affected users in compliance with applicable laws.
8. Limitation of Liability

- PentaBind will not be liable for any loss of data, whether due to malicious attacks or otherwise. You assume all responsibility and risk for data loss when using the Service.
- PentaBind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, business interruption, or loss of anticipated savings, arising out of or in connection with the use of or inability to use the Service.
9. Indemnification

- You agree to indemnify and hold harmless PentaBind, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
10. Dispute Resolution

- Any disputes arising from these Terms or the use of the Service will be resolved through arbitration in accordance with the laws of the United Kingdom, unless otherwise agreed by both parties.
11. Changes to Terms
PentaBind reserves the right to modify these Terms at any time. Your continued use of the Service after any such changes indicates your acceptance of the new Terms.
12. Termination
PentaBind may terminate or suspend your access to the Service without prior notice or liability, for any reason, including breach of these Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.
